Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you") and Atzy AI ("Company," "we," "us") governing your use of the Atzy AI platform, including all features, AI tools, integrations, and related services (collectively, the "Service").

By registering for an account, clicking "I agree," or otherwise accessing or using the Service, you confirm that you are at least 18 years old and have the legal capacity to enter into this agreement.

Atzy AI is an AI-powered CRM platform designed to help sales professionals and business owners manage contacts, track follow-ups, organize sales funnels, and leverage artificial intelligence for insights and communication assistance.

Key features include:

• Contact management with AI-generated summaries and coaching
• Sales funnel tracking and health analysis
• AI-drafted follow-up messages
• Gmail integration for sending and tracking emails
• Daily AI insights and briefings (Pro plan)
• Mindset tools including daily planner and monk mode

To use the Service, you must create an account using a valid email address and password, or via Google OAuth. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.

You agree to:

• Provide accurate and complete registration information
• Keep your account credentials secure and not share them with others
• Notify us immediately at support@atzyai.com if you suspect unauthorized access
• Use one account per person — creating multiple accounts to circumvent limits or trial restrictions is prohibited

We reserve the right to suspend or terminate accounts that violate these Terms or that we determine, in our sole discretion, are being used for harmful or fraudulent purposes.

Atzy AI offers the following plans:

• Free Trial — 7 days of full Pro access, no credit card required. Limited to one trial per account.
• Basic — $59.99/month. Includes 250 contacts, 5 funnels, and 10 AI follow-up drafts per month.
• Pro — $69.99/month. Includes unlimited contacts, unlimited funnels, unlimited AI drafts, and all Pro features.

All paid subscriptions are processed through Stripe. By subscribing, you authorize us to charge your payment method on a recurring monthly basis. Prices are in USD and subject to change with 30 days' notice.

Cancellation: You may cancel your subscription at any time from Settings → Billing. Cancellation takes effect at the end of the current billing period. We do not offer refunds for partial months.

Free Trial: Each email address is entitled to one free trial. Creating multiple accounts to access additional free trials is a violation of these Terms and may result in account termination.

You agree to use the Service only for lawful purposes. You must not:

• Use the Service to send spam, unsolicited messages, or illegal communications
• Attempt to reverse engineer, decompile, or extract source code from the platform
• Use automated scripts or bots to scrape, access, or manipulate the Service
• Upload or transmit malware, viruses, or malicious code
• Impersonate other individuals or entities
• Use the Service to store, transmit, or process data in violation of applicable privacy laws
• Resell, sublicense, or otherwise commercialize access to the Service without written permission
• Abuse AI features in a way designed to circumvent usage limits

If you connect your Gmail account to Atzy AI, you authorize us to access your Gmail data as described in our Privacy Policy. You understand and agree that:

• You are responsible for all emails sent through Atzy AI using your Gmail account
• You must comply with Gmail's Terms of Service and applicable anti-spam laws (CAN-SPAM, GDPR, etc.)
• We are not responsible for email deliverability, bounces, or spam filtering by recipients' mail servers
• Sending bulk unsolicited email through the Gmail integration is strictly prohibited and grounds for immediate account termination
• You can disconnect Gmail at any time with immediate effect from Settings → Integrations

Our property: The Atzy AI platform, including its code, design, branding, AI models, and all related intellectual property, is owned by Atzy AI and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose.

Your data: You retain ownership of all data you input into the platform, including contact records, notes, and email content. By using the Service, you grant us a limited license to process your data solely to provide and improve the Service as described in our Privacy Policy.

AI-generated content: AI-generated content (summaries, drafts, insights) is provided as a tool to assist you. We make no guarantees about its accuracy and you are responsible for reviewing it before use.

Your use of the Service is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our collection and use of your data as described in the Privacy Policy.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, error-free, or secure
• AI-generated content will be accurate, complete, or suitable for your specific use case
• The Service will meet your specific business requirements
• Emails sent via the Gmail integration will be delivered or not marked as spam

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ATZY AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

You may terminate your account at any time by contacting us at support@atzyai.com or through the account deletion option in Settings.

We may suspend or terminate your access to the Service immediately, without prior notice, if you breach these Terms, engage in fraudulent activity, or if we discontinue the Service. Upon termination, your right to use the Service ceases immediately.

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date and, where appropriate, by email. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes.

These Terms are governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration or in courts of competent jurisdiction, as appropriate under applicable law.
